HiveMP Terms of Service

These terms of service (“ToS”) govern your use of the software as a subscription service named “HiveMP” (“System”), and the content found within it.

1) Introduction

This System is owned and controlled by Redpoint Games Pty Ltd (Australian Business Number: 88 611 889 626) (“Redpoint”). By subscribing to the System in accordance with the procedure at clause 2 below, and using or otherwise accessing the System, you acknowledge that you have read these ToS, and that you agree to be bound by its terms and conditions.

If you do not agree to the terms and conditions of these ToS, promptly exit this page and do not register for the System, or continue to use the System or any of the content provided within it.

2) Registration

  1. To subscribe to use the System, you are required to register for an account (the ‘Account’).
  2. As part of the registration process you are required to provide personal information about yourself (such as identification or contact details), including:
    1. an email address;
    2. preferred username;
    3. a password.
  3. You warrant that any information you give to Redpoint the course of completing the registration process will always be accurate, correct and up to date.
  4. Once you have completed the registration process, you will be a registered member (‘Member’) and agree to be bound by the Terms.
  5. You may not use the System and may not accept the Terms if:
    1. you are not of legal age to form a binding contract with Redpoint; or
    2. you are a person barred from receiving the System under the laws of Australia or other countries including the country in which you are resident or from which you use the System.
  6. Use of any personal information you provide will be done in accordance with the Redpoint privacy policy, a link to which can be found at clause 14.

3) Term

This License will apply for as long as you continue to lawfully use the System. However, this License will terminate automatically without notice from Redpoint if you fail to comply with any of its terms or conditions, including a failure to pay the applicable fees. Upon termination you must immediately cease using the System and any content within it. The Limitations of Warranties and Liability set out at clause 10 below will continue in force even after any termination.

4) System Availability and Outage

4.1 Redpoint uses all reasonable commercial endeavours to keep the System operating at all times. Nonetheless, the System may experience outages from time to time. Such outage may be caused by third parties, or may be a consequence of Redpoint maintenance activity, where we are looking to improve the quality of the System. In circumstances where we know in advance that an outage is likely, we will provide notice in advance, so that you may back up your systems. Whatever the reason behind the outage, we will use all reasonably commercial endeavours to ensure that your data is safe. However, we cannot guarantee this. For this reason, we recommend that you back up your content regularly.

4.2 The System relies on third parties to provide you with your data. Should the terms of service from those third parties change, our ability to provide the Service may be impacted. When circumstances beyond our control change the scope of the System, we will immediately inform you.

5) Fees and Payment

5.1 Pricing is listed on https://hivemp.com/pricing/ and is subject to change (with notice given to email addresses associated with active billing accounts). We bill on a pay-as-you-go basis, and our accounting systems are the ultimate authority on what resources were used and how much a customer will be billed. Customers are free to contact our support channels if they have any questions, but ultimately if our billing systems say that a customer has used X amount, we’ll bill them for X amount.

5.2 All payments are facilitated through Stripe (‘Stripe’). When making any payment in relation to your use of the System, you warrant that you have read, understood and agree to be bound by the Stripe terms and conditions which are available on their website. Please note that depending on your location, these terms of service may vary slightly. Ensure you read and understand the terms of service that apply to you.

6) Intellectual Property

The System and all content within it is protected by Australian and international copyright law, and is the exclusive property of Redpoint, or lawfully appears within the System through fair use, or under licence. Unless otherwise indicated, all rights (including copyright) in the System, and any content found within it (including but not limited to text, data, video, code, scripts, design elements and interactive features), are owned and controlled by Redpoint. All System trademarks, service marks and trade names are owned, registered and/or licensed by Redpoint.

7) Your Conduct

Your use of the System is subject to all applicable local, state, national laws and regulations. By accessing and using the System or any of its contents, you agree to be bound by those laws. In addition, you agree that you must not:

  1. make copies of the content on this System, except as expressly permitted in these ToS or as is otherwise permitted by law;
  2. translate, reverse engineer, decompile, or disassemble the System or the content within it;
  3. remove or alter any copyright, trademark or other proprietary rights notices contained in any Redpoint content, or content that appears through a third-party supplier;
  4. unlawfully copy, reproduce or create derivative works based on the System or any of the content within it;
  5. use the System or any content within it for any unauthorized purpose or in violation of any applicable laws or regulations; or
  6. modify, alter or attempt to modify or alter the System or any content within it, or merge all or any part of the either with another System or program.

Redpoint may take any actions and impose any penalties we deem necessary to discourage and/ or stop any violation of these terms, or any other illegal or inappropriate conduct, all without prior notice or warning.

8) Publicity

By using the System, you grant Redpoint a non-exclusive licence to identify you as a user of the System on the Redpoint website only (“Website”). At your request, Redpoint will remove you from the Website within 7 days.

9) Third Party Services and Content

Third party services may be linked to from within the System. Redpoint do not monitor or have any control over any content on these services, and can make no guarantee as to their accuracy or completeness. We do not represent or warrant the accuracy of any information contained on any third-party service. Accessing or using content on any third-party services is done at your own risk.

10) Limitation of Warranties and Liability

The System, and the contents of the System are provided on an “as is” basis, without any warranties or conditions, express or implied, including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose, or any warranty arising by law, statute, usage of trade, or course of dealing. You assume all responsibility and risk for the use of the System and for the use of any third-party service, and Redpoint disclaims all liability for any loss, injury or damage resulting from use of the System and any third-party Service, whether direct or indirect.

In part, Redpoint relies on third party services to provide information to you. Redpoint does not make any warranty about the accuracy of information obtained from these third parties. Should those third parties change their terms, discontinue, or otherwise act in a manner that compromises Our ability to gather data and provide the System, we will let you know. However, you acknowledge that this outside the direct control of Redpoint, and it can never be held liable for any such third-party activity that results in a change to our ability to provide the System.

In no event will Redpoint have any liability to you or any other person or entity for any compensatory, indirect, incidental, special, consequential or exemplary damages whatsoever, including, but not limited to, loss of revenue or profit, lost or damaged data or other commercial or economic loss. Redpoint’s total aggregate liability with respect to its obligations under these ToS or otherwise with respect to the provision of the System will not exceed $AUD1.00. The limitations in this section will apply whether or not the alleged breach or default is a breach of a fundamental condition or term or a fundamental breach.

11) Indemnity

You agree to indemnify and hold harmless Redpoint, and its subsidiaries, affiliates, officers, agents, and employees, advertisers, licensors, and partners, from and against any third party claim arising from or in any way related to your use of the System, violation of these ToS or any other actions connected with use of any content, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature.

12) General

These ToS is the entire agreement between you and Redpoint with respect to the subject matter hereof, superseding any other agreement or discussions, oral or written, and may not be changed except by a signed agreement.

Redpoint may amend and/or modify these Terms of Service at any time in its sole discretion. Check back to this document from time to time. Your continued use of the System constitutes consent to any changes.

13) Jurisdiction

These ToS will be governed by and construed in accordance with the laws of Victoria, Australia. You agree to be bound by the laws of that state.
